Are union dues tax deductible?
Are union dues tax deductible for U.S. workers? I’m interested in understanding when these dues may qualify for a tax deduction and whether the rules differ based on employment or state.

Not deductible for most W-2 employees at the federal level and this is now permanent, not temporary. Union dues aren't deductible on a federal income tax return for employees, but self-employed workers can deduct them as an ordinary business expense on Schedule C under IRC Section 162. The TCJA suspended that deduction starting in 2018, and the One Big Beautiful Bill Act, signed July 4, 2025, made the elimination permanent so it won't "come back" in 2026 as some older articles predicted. Exceptions: Armed Forces reservists, qualified performing artists, fee-basis government officials can still deduct via Form 2106. States like California and New York didn't conform to the federal suspension and still allow the deduction on state returns. Check your state's rules.

Not deductible to the majority of W-2 employees at the federal level and will always be so in the future and is now permanent, not temporary. Union dues are not deductible from federal income tax returns for employees, but for self-employed individuals, they are deductible as a normal cost of doing business.

The majority of W-2 workers cannot deduct union dues from their federal income tax return as of today, and this situation will never change in the future since it has become permanent rather than temporary. It should be mentioned that W-2 employees do not have the opportunity to deduct union dues from their tax, while self-employed people can.
